I know that in Mississippi the DUI is .08, and the DOT regs. use .02, We have an employee who tested .036.

Was the employee driving or was it a random in office check? If driving then I say zero tolerance! What if he killed someone, dose your company want that kind of liability? And I can promise you that if it happened once it will happen again.

Most companies have zero tolerance if the employee was at work and tested positive? They should be terminated.

Get the documentation on your fingers on your documents. Then call & make an appointment along with your former company's workers dept manager. Ask to have all derogatory guidance deleted out of your record. Ask to have decrease back wages paid to you. in case you opt for the pastime decrease back, ask to have your pastime reinstated.

I have a no tolerance policy. Immediate termination for someone that poses a liability to themselves, their coworkers and the company.
