That is not true. For example littering is illegal. If no one sees you littering, it's still illegal.
The laws do not say someone has to see you doing it. Besides, you see yourself do it, don't you?

There are rarely witness to murders, yet murderers still get arrested. A law is a law. You either break it or you don't. It doesn't matter who sees. If I drive 75 in a 55 zone, I am breaking the law, I just will not get punished. As for more serious crimes, you gotta live with it on your conscience if you break it.
