The lady is trying to charge me $850.00 for one little scratch. There was no police involved or no report done because I dont have a valid liscence. I offered to take care of things and she accepted quickly by taking down my number and address now she calls me and says she will need a 3 day rental while her car gets fixed and it will be a total $850.00. I offered to take the car some place cheaper and she said no. Did I mention that my car was really damaged and her car is a bucket? Really old.

That's probably about right to replace a bumper. However, for a scratch that isn't necessary. She most likely has no interest in having the work done or using a rental and would like your money.

Call her out on her plan and offer a settlement, maybe $200.

$850 to get a bumper repaired is what a repair shop would charge. My wife's car's bumper got hit and a divot was made in the bumper, the repair place charged $1300!

The problem is you offered to pay, and if you rear ended her you were at fault. Be glad she is not pressing charges, or going to the doctor and handing you medical bills.

My advice to you is.
1. Tell her to take the car to the place that she wants to get her bumper replaced/repaired and PAY the place directly. This keeps her from pocketing the cash and allows you to place it on your credit card.
This will also give you a RECEIPT of the repairs that were done so she can't attempt to sue you afterwards.

2. Write up a document that indicates that she has accepted the repairs made to her vehicle as a settlement to the accident you had on the specific date and place of the accident. Have her sign the document and have a witness around, preferably some third party, if not at least have a friend witness the signing of the document. (Make 2 copies so she will be able to retain one, or she may not sign)

Make sure you keep all this documentation in a safe place for several years to ensure she doesn't come back after you for some unknown reason.

Consider it a lesson on why it's not worth driving without a valid license or insurance.

No insurance? Or you don't want insurance to get involved?
You can go to a local auto appraisor, they will most-likely be able to tell her what the real damage is/will cost. As far as the rental - you can say that you'll pay only for the time that her car will actually be in the bodyshop. They can order the parts in advance and then let you know when they come in.

Also - most likely she just wants the $$ and will not get the work done. Make sure that you give the $$ to the shop owner, after the work is done (or do 1/2 and 1/2 payments).

First off, you shouldn't be driving without a valid license, but aside from that. Tell the lady that if she wants you to fix it, you will have it estimated at a shop of your chosing. Aside from that, yes, you are in an odd predicament by not having been on the road leagally, but she has put herself in an equally odd situation, by not calling the police, she has violated the law that requires you to have police present for any accident that results in damage to vehicles totaling more than $500. And if she jumped at the chance to settle it with no police involvement, she may not be completely legal. tell her you are more than willing to settle this with her, but she is being unreasonable and trying to take advantage of you. Also inform her, that is she choses not to go this route, she will want to think twice before doing anything about it, seeing as she has already broken the law, and her insurance company will either drop her or significantly raise her rates when they find she failed to report an accidet as required by the contract she has with them.

Doesnt a device save sell like those different colored marker thingies. I dont think of an elementary cleanser might dissolve the scratched section and demonstrate the unscratched section below.

if the bumber was broken and she needed to replace the guard under it, maybe including painting bumper but for a scratch. I would think probrably about 200.00 to take out dent and paint bumber. I think she just saw an oppurtunity to make some easy money. Thats my opinion.

she has the right to get it fixed where she wants to. if she sues you and it rules in her favor, the judge might try to get you a fair deal. these are the things that we all must think about while driving. if she does sue you and you are found to be driving w/o a proper license, then you could be in even more trouble. you are lucky she wasnt hurt, judge judy would have a field day with you.
