My child's father does not have a legitimate job, he lives in another state, he does not do anything for the child (almost no phone calls, no money sent, no visits to the child). I provide all care for my child and he has lived with me since birth. I need to file for child support but I don't have alot of money to spend on court fees, lawyers, etc. Does it cost much to just file for it? Can I file for it in CA even though my child was born in another state? Even though he doesn't have a ligitimate job, will the father still be liable for a fixed amount? Do I not get any actual money until his wages are garnished? These may seem like stupid questions but in the state of CA it is not easy to find resources on the this. Does anyone know of any?

Every county's district attorney's office has a section that does nothing but file for child support, without charge to the custodial parent.

Check the front section of your local white pages telephone book for the number. If you can't find it, call your local county supervisor's office and they'll be able to help you.

First off, these aren't stupid questions. I have a lawyer and I'm still confused as to what's going on with some of these things.

When I was recently at the Santa Clara County Family Court house, I noticed that they had a window where people can come in and ask questions pertaining to filing child support requests on their own. They also had a whole mess of paperwork up on the walls to show you what needs to be filled out, with examples.

I would highly suggest going down to your counties Family Court building and talking to someone there. They will be able to give you all the numbers and facts and answer any sorts of questions you might have.

in california this is abandament and he can loose parental rights go to prison for being a dead beat dad and the state will pay for the support of the children and he will have to pay back every red cent till the day he dies thats how you get the sorry sob. see once in that jail system they always know where you are they make him work a real job and will have to report to a officer everyday he makes your children lets see him squirm a little go to social services and you can work and get these resources then go see the D.A. does not cost a dime only precious time

Just file for any type of welfare for the child and the welfare dept. will take care of that for you, they hate to spend money on a man's child if that man has any resources at all.

its not a stupid question, none of them are. they are all understandable, you dont know what to do first.

file for welfare. they do all of the paperwork, for free. they get the child support order and will go after him worse then the IRS. after all the paper work is done and court orders established, go OFF welfare, then you get your payments.

another state does not matter.... today, the states are linked when it comes to child support.

also, you dont need an attorney for child support. its an amount the court will calculate. if one parent isnt working, they calculate an amount for them (usually minimum wage amount unless they are skilled workers).

just click on your state and fill in the calculator.

and just go file, for he isnt doing squat now. and the honor system has proven not to work. he's going to have to be court ordered to.
