i worked at a clothing store for alomost 2 yrs but then i left to go and get married and moved away i had my mail forward to me and i still have not recieved my w2 form for my taxes i even called my old boss and she gives me the run around she said there is sumthing wrong with the mail and that she infact took a long time to recieve it but she did get it at least she keeps tellin me to wait a week i keep doin so it has been a month and still nothin is there a number to call also could it be because i have a new last name what do i do????

Go to the post office and get a 1040 tax book and it will have the number for the regional IRS office in your area. Give them a call and get their advice. If you have your last pay stub and it has year to date amount paid and withholding information on it us that as a guide in filing your tax with a note you did not receive a W2 from whoever your employer was along with the address. If you fail to declare this income along with your SS# and your old employer does then the IRS will be after you for failing to declare your income. If you don't have any records estimate what you were paid and what was withheld and note it on your return when you file your taxes. This will take the liability of any penalties off of you if there are taxes owed when the IRS gets the info from your previous employer.

You *can* file your taxes using a substitute W2, but as part of the process, you must be able to state that you have made a diligent effort to obtain the W2 from your employer. You have some time left, so here is what I would suggest:

Write to your employer. In your letter, ask them for a copy of your W2. Provide them with a self addressed, stamped envelope to mail it back to you with. You could even send them a prepaid overnight envelope, etc, something so you can track that the letter was sent, etc. Hopefully, this will allow you to file your taxes.

If that doesn't work, then you will need to file using a substitute W2. This means you will have to file on paper, and any tax refund may be substantially delayed. You would need to try and find your last paycheck stub, hopefully with year to date withholding information on it. If you worked for the same employer last year, your previous year's W2 would have their EIN. Also note: upon receipt of a substitute W2, the IRS will contact the employer and demand the information. If the employer's information varies from yours, you will need to file an amended return.

Call the IRS. There is a complaint process for this and a process to get your taxes filed on time to avoid a penalty for you. It is the RESPONSIBILITY of your former employer to get the paperwork to you by the deadline. The IRS can tell you what that date is. Hope it helps, Good Luck!

First ask the employer to fax it to you to see if he did his job. If he says we won't fax it, tell him you will contact the IRS, if he still does not, he is probably behind on his work and needs to be reported.
