Florida Statute 784.07 relates to assualt on a law enforcment officer, EMT, or private security officer, (and others) while in the performance of their duty. It provides for sentence enhancment, i.e. from a second degree offense to a first degree offense, etc.
It also states that the minimum term is 3 years for the felonies, but doesn't give the maximum. NOTE: It also prohibits deferred adjudication (diversion), early relase (parole) and good time credits.
If you have been charged with an offense under this statute, you need to retain an experienced criminal defense attorney immediately. Contact your local or state bar association for a referral.
