Hasn't this always, and rightly, been the exclusive place of the legislature, not judges? See jcraighead@mogop.org

Resolution 1, recently passed despite Democrat opposition in the Missouri House of Representatives, prevents Missouri courts from approving tax increases without approval by the voters or the Legislature, which has the sole taxation authority under the Missouri Constitution.

Checks and Balances. Judges ARE supposed to rule on the constitutionality of laws.

If a judge lowered a tax, would you be complaining?

Activist judges have taken away more civil rights than the Patriot act or the war on terror.

Can't people see that regardless of the merits of any judicial decision in such matters, it is the opinion of one or a small group of unelected people.

Such decisions even if right or for the good of the population are done without the public debate that should be the process for important decisions in a democracy.

The absence of a public debate in Congress on Roe V Wade, is a great loss to our society. Hopefully the decision would have been the same, legal abortion, but at least people would have been able to have made their statements. Instead we rely on the decisions of a few old men.

Any decision by a president can only last 4 years as he can be voted out of office, and reversed by his successor on the other hand judges rely on precedents and that can be messing a situation up for much longer.

It is like the crazy Catholic church, past decisions are "infallible" so when the judges make a bad precedent it is very hard to reverse.
