My brother owes a few thousand dollars in child support arrears and is required to pay 50% of the day-care expenes along with the normal monthly payment based on the judgement he recieved from family court (NY).
He lost his job and in inelligible to recieve unemployment. The child support collection unit has suspended his lisence, is threatening to put him in jail and freeze his accounts.
Is there any way to alleviate these actions?
He filed for a modification, but the date isn't for another month. He has no lawyer and can't afford one at this time.
Are there any options or steps he can take to alleviate this problem?
Any and all information would be helpful...he is not a deadbeat and sees his kids regularly, but is a victim of circumstance at this time financially. No bashing please!

Sorry, he lost his job due to downsizing and he wasn't there long enough to collect unemployment. He has applied to other jobs and have been turned down...still working on it. His car was reposessed and he was evicted from his apartment. He is not a loser, just trying to survive and help his kids too!

Oh and BTW he applied at McDonalds, BurgerKing, Wendies and most of the fast food industry only to be turned down for being overqualified...It's not that he doesn't want to pay, he can't pay. I am going to tell him to apply for Welfare until he can get back on his feet. It's not like he is required to pay 40 a week he has to pay 1200/month! what about that?

Each state has its own laws...
He should attempt to make any payments he can
He can apply at a temp agency for meidation work.
He can get on ht eschool board's substitute list.
He should qualify for legal aid.

He needs to find another job, even if its temporary. Being unemployed is not an excuse not to feed your children. Any bill will not cut you any slack just cuz your are unemployed.
It will show good will in the court if he pays at least some of what he owes. Your brother need to ubnderstand that even if he is unemployed, he is still responsible to pay child support, at least theminimum, which is 40 dollars a week. Tell him to pay what he can until the court date and to get moving with getting a JOB.

i understand,my son has had problems like this and can never seem to catch up he pays dilligently every month plus buying and giving the girls money,was out of a job for awhile and got behind has worked 7 days a week for the past 2 yrs and 3mths the more money he makes the more they raise his support,there is no way you can alleviate it,they put a freeze at that time on his banking account and because i had put his name on mine if i fell ill they froze mine,he had to explain and prove to the child support district atty that it wasnt his,tell him to catch up enough to satisfy them for the time being and get an atty to help they will freeze his banking acct as well as arrest him,my son wasnt arrested only because he found out what it would take to appease them until he got a job

In all honesty, his best action is to get another job as soon as possible even if its working at McDonald's. He might need to get a couple of them if that is the route that he takes for now, but any payments is better than no payments. I have been in this situation in another state, and the states are generally not that sympathetic. Best of luck to your brother.

Open the newspaper and start applying for any and all jobs listed. Without child support your ex-sister-in-law is not going to be able to provide adequately for the kids. The child care center won't want to hear they will only get 1/2 of the weekly pay either so she could lose child care. He needs to be working on getting a job asap. Has he thought what that modification will mean to his kids? What necessities are your ex-sister-in-law going to have to cut back on in order to keep a roof over their head and food on the table? Even if he needs to work 2 jobs to make what he did at one, he needs to get working. Good luck to your brother and God Bless.

nope !! only employment will help him out !! and the ex forgiving him for the amount owed unless she is on welfare then she can not do that .
any employment would help him out, making any sort of payment even if it was $20.00 that would show them he is trying to pay . maybe have him take a paper to the places he applies st and having the supervisor signing it would help prove to them he is trying to find employment .

Can he talk with his ex? I am lucky enough that my ex and I get along. I don't if she could call someone until he gets back up on his feet.
