i dont think that is right at all. the kid cant live in an adult prison. he'll get eaten alive. plus its not even his fault.

It is now becoming the issue of not his mental capacity but the ability to know the difference between right and wrong. Did he know it was wrong to pick up the gun in the first place? Did he know that killing in itself is wrong whether accidental or purposely? There are also issues with the parents that aren't being disclosed here. A mentally challenged person with the legal mentally challenged IQ of approx. 75 is considered mentally challenged but can still know the difference between right and wrong. Get a lawyer for sure to appeal at least to have this child put into a facility for the mentally disabled.

If this indeed is true first of all the court system would have to do a phsycological testing to see if he was able to stand trial as an adult, if he was found as a child he would have been placed in juvy until he became of age for adult prison. Sure you have your facts right.

Where'd you hear that? And he can always appeal with a better lawyer.
