This child is not yours, a Paternity Test will prove that, so you don't necessarily have to worry about paying child support. But, i guess you will have to pay the hospital bills (whatever insurance won't pick up). The best advise is to get a lawyer and file for divorce. If you can both agree on the terms and conditions of the divorce, it can be over in 3 months...hopefully before the baby is born. And, hey, did you ever think that you can call and have her taken off of your insurance?

If you can prove that you have not been living together the past two years, then you should not have any problem. You do need to go see a Lawyer though ASAP and file those papers which should have been done a while back. She may still try to claim the child as yours, which may result in a DNA blood test. You have been paying for her Insurance coverage all of this time you were separated???? Why? If the child is not yours, she would be wrong to put your last name on the Birth certificate. You may need to record any phone conversations you have with this woman in the future for evidence..

Wow... that's tough. She's still on your health insurance? Does she pay the premiums for the health insurance? I don't know what state you live in, but I would call the court system in your area and find out how much to file paperwork for the divorce. You've clearly been separated enough. Would you be kind enough to leave her on your medical until she had the baby? Tough spot! Good luck, but I'm sure you aren't legally responsible for the child if that is any consolation. Keep any emails or correspondence where she tells you that the baby isn't yours - just in case.

Man, you are out of luck, technically, this is a child of the marriage, because she conceived it while you were married. This will be considered your child. I would file for divorce immediately. As soon as the child is born, request paternity testing. The big catch is, even if it is proven that this is not your child, the Court's will not bastardize a child. It will be your child until paternity test prove the child to be someone Else's. You may be stuck paying for this child for the rest of your life. Lets just hope that the real father passes a paternity test.

Well she committed adultery to start with. A seperation is not a disillusionment of marriage. Here in the U.S. you would not be legally liable for the child. If you do live here in the U.S. I suggest you tell her to tell her lover to get some insurance because you will not have this child taking YOUR last name, as it is NOT your child. In the U.S. you do not HAVE to be legally responsible for someone else's children. Get a back bone as well as a lawyer.

You have rights!!! You have no obligation to her, or another man's child. The baby will also not have your last name because you are not the father. the Birth Certificate asks for the father's name, and it must be signed by the father.
Also, she got pregnant with another man during your marriage, which is considered Adultery. If anyone has problems right now, it's her!!!
YOU NEED A DIVORCE IMMEDIATELY!

If you are separated all you have to do is prove that you are at different addresses, postal service can confirm that.
The man who impregnated her is responsible, not you.
I would file for divorce and do it yourself if you don't have any assets to divide.
you can file for irreconcilable differences after 1 year in Canada.
You can't do much more than that right now.
of course you know that DNA testing would prove you are not the father. get her off your health benefits, if you are not together... There are no papers as you say and you can delete her from your medical. You owe her nothing..... Do not let any guilt play a part here, she might try to use you.. that should open up your eyes.

I'm assuming there's NO chance it's yours.
In that case, get a good lawyer. I'm a woman, so I hate saying this, but your wife will try to screw you over because it sounds like her new love interest is very undependable. You should, of course, be civil with her, but you are not monetarily responsible here. You have to protect yourself.
Your lawyer will also probably advise you to get a paternity test just to be sure. And also start divorce preceedings.

If you are listed as the father of this child, you could end up paying child support for the next 18 years. Get a lawyer TODAY! It will be cheaper than 18 years of child support.

You should file for divorce! If that child carries your name and is born during the term of your marriage YOU will get stuck paying support for him/her.
Contact a family law attorney immediately so you don't get burned!
