We also can not locate his last check stub to verify the amounts that we need to show on the substiture w-2 form. What is my next step?

Contact the IRS. There is a form to fill out which can be found at their website. The employer will be fined...and your son should be able to file without the w-2.

Contact the coporate payroll by pass the locals. They cannot withold his w2 forms. He can have a tax attorney request them in a form of a letter or an accountant. If this proves to be too expensive write and request it in writing signed by a notary and send it certified mail with a delivery confirmation! They will know he is serious! Call the IRS they can help because this is breaking the law they could get in trouble I would report them and do all the above you might have a case. This is malice

Was it the employer from last year. It so they have to have mailed one out by January 31. After that they are not obligated to furnish you with one and if they do they can charge you a fee for the copy.
