Can she do it without her fathers consent? If we were to take it to court would it be the child or the adults who are actually taking it to court? Would we get legal aid?

She can do it without her father's consent if the court rules that, for some reason, the father's opinion shouldn't count..... if it never even comes up, though, I don'tthink the courts will ask. I'm not sure if it would be the child or adult(s) who take it to the court, but she WOULD need the consent of at least one parent or guardian.

Talk to a lawyer. Is she being adopted by another man? Does she want to take her mother's maiden name? Your income depends on whether or not you will get legal aid.

Unsure of your circumstances of daughter wanting to change her surname but I looked into changing back to my surname for me & my son. if I understood it correctly if theres been no contact from absent parent for a certain length of time change of surname is a simple process, otherwise I think he can object.

You can just start using another name and don't have to do anything legal.
