There are two forms of custody...Legal custody/physical custody.
Legal custody is that he gets to help make the decisions regarding your child's health, welfare, school, etc.
Physical custody-who the child primary lives with, visitation rights to the other parent. Children bounce from household to household all the time. the courts find that frequent and continous contact is in the best interest of the child.
you don't have to stay in the marriage, but expect to share custody of your child. when you file, make sure you also go to court immediatley for child support.

Im really surprised by the reaction of some people who think that women in middle easterrn countries are treated like 2nd or 3rd class citizens and also by the antipaki comments. Well im an indian woman and i don't think so that im treated badly by my husband or anyone else. But one thing is true for sure that Americans are not very good when it comes to general knowledge. I just want all of you to go and educate yourself a little bit before coming here and doing an exhibition of your tiny little brains. And honestly i think that it is the americans who treat women like crap by getting involved in so many women at the same time. Your lives revolve only around sex . That's what you do when you are in highschool or in college or even when you are 60 year old or when you are in grave. Well i can say that im proud to be an indian and married to an indian who respects me a lot.

Marry a Pakistani, Turk or anyone else from the Middle east or the surrounding area and this is the rsult. madam, all woemn in these countries are normally treated like 2nd and 3rd class citizens.
So you're right...get the divorce. Careful with the kid though. Theres always that possibility he can grab the kid and high tail it back to Pakistan and then you've got a new problem at hand to deal with.

Following up on Diane's question... yeah, why are you so stuck on the fact that you're an American and he's a Pakistani? Sounds like you really should not have married this guy in the first place due to some inner feelings within yourself.
Yes, he is entitled to custody, it's his kid too. and you're daughter is just going to have to deal with her mother's mistakes.
Life isn't fair for the young and defenseless is it?

why does the fact that you are American and he is not make a difference? is he legal in the country... go after him for the support and normally the mother retains custody unless she is unfit. If you feel he is a flight risk then make it known but to stay in a relationship just because is not what is best for you or your child. leave him and file for sole custody.
