How do you "almost fracture" a hand? It's either broken or it isn't.
Is there anything wrong with the elevator doors or did she get her hand caught because she brilliantly stuck her hand in the door as it was closing?
Seriously. You don't get your hand caught unless you stick it in there.
My guess is that you would have zero case because she caused the "almost fractured" hand herself by sticking it in the door as it was closing which anyone with half an ounce of sense would know not to do.
Unless you can prove that the doors were defective or faulty or something and somehow caused her to almost fracture her hand, you have no case.
By the way, what is the injury? You can't sue unless there is an injury. Almost fractured isn't going to cut it even if the doors were faulty.
Back when I was a claims adjuster, this is what we used to call a nuisance claim. Some scam artist that managed to do something stupid but now wants someone else to give them a bunch of money for their stupidity.
Additional answer now that we know the child is 14 months not 14 years. Who's hand got in the elevator? The mother or the baby? You also said the elevator was causing problems already but that doesn't explain why she stuck her hand in there. No one should stick their hand in a door when it's closing whether the elevator is having a problem or not. Elevators all have inspection certificates. Tell her to ask to see the certificate and find out when it was last inspected. If the building owner is not maintaining the equipment, and there really is a broken elevator that somehow trapped her hand, then you possibly have a case. However, "almost fractured" still is not an injury.

Let's hope there is no recourse for stupidity...the only way anyone can get their hand caught in an elevator is if they shove it between the doors to attempt to stop it from closing.
And what the hell is with the 20/14 yr. old comment?? A 20 yr old cannot possibly have a 14 yr old unless it was her sister!

The other poster is right - it's either fractured or it's not - there is not diagnosis as "almost a fracture".
The only way one gets their hand stuck in an elevator door is to put their hand in the door, be it to hold open the door or to try to stop it from closing. Either way - putting your hand in the door is not a smart idea.
As far as "trapped" in the door. Define trapped?
There are alot of things that make you go hmmm - did she seek medical care? does she have true injuries (almost injuries are not diagnoses)? who witnessed this "trapping"? and above all else why in the heck was her hand in the way of a closing elevator door?
