I rent a house previously rented by someone else who has outstanding debts. I have been receiving letters (reminder, warrant of execution, bailiff removal) that I have sent back advising that the person does not live in the property anymore. I have received the visit of bailiff threatening to remove my household effects to satisfy unpaid amouns at any hour of the day or night... I have called them and they want me to prove who I am? Is it legal? What else can I do?

get in touch with the people who you rent the property off and tell them to notify the bailiff company that the person no longer resides at the said address

If they are court bailiffs then yes but you can very easily prove you are who you say you are with a bill or bank card or passport or driving licence don't be affraid just ring up the company involved and you may well be abe to sort out the problem over the phone

Whatever you do DONT let the baliffs in even if they are being nice!They will do anything to get in your house. They have no legal powers unless they have been over the threshold before. If they turn up talk to them through the door or go down to them, but once they step foot through your door they are legally entiled to come back, they are even allowed to break in and there is nothing you can do. If you dont let them in in the first place they are powerless. They will try and tell you they are allowed in regardless, this is not true. Send them a copy of your tenancy agreement, that is proof you live there. Baliffs are bullies and they will try everything to get in your house legal or not. Once you have sent them proof and they are still harrassing you, then take them to court for Harrassment. Harrassment is a criminal offence

I'm not sure about the legal side, but if all they want is for you to prove your ID, wouldn't it be easier and less stressful to just do it? That way, if they keep on contacting you, you could get legal advice on how to take THEM to court for harassment.

You could try contacting the Consumer Credit Counselling Service, its a charity set up to help those with credit problems. I know it's not YOUR credit problem, but they would probabaly be able to advise you on where you stand legally.

I am going through the same thing - I told them I would call the police and get them done with harrasment if they didnt leave me alone. That seemed to the trick.

Unfortunately the credit rating of the flat is affected by this so it is hard to get credit for anything using this address despite how clean your credit rating is.

Firstly contact your landlord and advise them of the problem straight away - ask them to contact he companies to advise them that the previous tennant does not live there.

Or if it was me i would do the above and also send a copy of your tennancy agreement to them.

Do not under any circumstances let them in to the property.

I would also on the safe side contact the CAB and ask for further advice on any legal implications.

i had the same problem make sure you open every letter and contact them explaining the situation you should have a tenancy agreement from your landlord photo copy it and send it to all with a very strongly worded letter go to your local sorting office and ask them to stop any post for the previous tenant to stop good luck x

just call the owners of your rented house and ask them to get it sorted for you///if when the bailiff visited you why didn't you invite him in and show your I D by any means possible i would have thought that would be the end of it had you done that
