i did an exchange over the phone with tmobile because i forgot my unlock code. so they said ok will send you out a new phone but send us back the locked one.well i rememberd the code and the phone came and i said i never got it i did it 2 times already. im going to sell the phones . tmobile said they wouldnt charge me sence they think i never recived it and ups just dropped it off at my doorstep so there is no signature so theyll think some one stole it. But what can happen? its not insurance fraud cause i didnt do it through insurance.

It's definite fraud. Depending on what state you're in it may be called, "Theft by conversion", "Theft by deception" or other similar wording.

And this is why other honest people pay more for cell phones (and other things too).
