Well you'd have to ask the doctor or coroner. They're the people who are authorized to say a person is dead. But if you really want to consider it, you don't perform CPR on a conscious person, so it could be a toss-up.

When you enter into performing CPR, you must continue to perform CPR until paramedics arrive. You are legally bound to do so.

i never thought of that. the idea of when a person is dead has changed over time. still, it is like breathing life back in. sometimes they don't wake up.
