Maybe the other party has decided not to file them. There is a time limit on filing; I don't know how long. If they don't file during that time, you're safe.

Because they are still creating the charges. You go to court for the indictment, they have no charges. They just want to know if you plead guilty or not. But then, they´ll set up their paperwork and send you to a bigger court of that county in that state, (because it´s a serious charge) and there you WILL have charges filed against you.

its the police what charge you, when your charged you get a summons to go to court, if you've had a summons & gone on the correct date & the courts have no papers for you the police have messed up, OR the person you hit has dropped all charges. then it might go back to the police & they can take it up. thats the UK anyhow..
