I had the same thing happen to me. I divorced my wife and my lawyer put in the agreement that she would reclaim her previous name..but she never changed her name from my last name. I think its because she had a real bad credit rating under her old name..
My lawyer said anyone can call themselves anything and that would be legal as long as they were not breaking the law..this was done in Michigan in 1979

I'm sure it isn't illegal to use his name. I got my maiden name back when my exhusband and I divorced. But I still used his last name until I remarried.

No it isn't legal for her to continue after she has had time to change it on all of her paperwork like her drivers license and SS-card etc. You would have to check the time limits in your state.
