It is very illegal to do that! It's even illegal to make copies of cd's you buy if sold and not just kept for backup copies at home. Like another answer says: most tickets tell you expressly no recording devices allowed, and the music whether live or not is still copyrighted by that artist. would you like your music sold everywhere without you making any profit? that's why it's illegal, plus if you sell it on ebay, you can so easily be traced you're going to go down if you do it, and it's an at least $500 fine or jail time for you... be careful and don't do it.

If you recorded a live performance and put it on a CD, it is still illegal to sell it. The band owns the rights to their music. To do it legally, you would have to enter into a marketing agreement with them (and the record label they are contracted with) and pay royalties from the sales. If you recorded the performance without the band's knowledge, that is called bootlegging and it is also illegal.
Now, if it is your band, that is a different matter entirely. Then it is legal.

Without the band's express permission, making a copy of their performance is illegal in itself. Selling these copies is 'more' illegal.

Yes it is illegal.
But i know of a successfull seller on eBay who sells tons of CD's. They copy them and then put them into a white sleeve with a sticker on them that says "promotional use only".
I contacted eBay. As long as they make money they dont care and this person has made a killing.

It depends on what band, and where you went to see the live performance.
Usually, when you enter a venue, somewhere on the ticket, or posted somewhere, there will be some fine print stating, "no recording devices allowed on premises."
Then it is illegal. But who cares anyway....

If the artist takes you to court you will loose. If you make $$ they need to get paid. Or get a written permission from them.

Matters if the material is copyrighted, ex Music, Computer programs, Certain pictures, etc.
If it is your own creations, words, music...no. But if it is someone elses, yes.

Yes, It's called Piracy, and punishable by federal law, I wouldn't even try it, its not worth it and they are REALLY starting to crack down on piracy. It's becoming a major problem.
