First, get a new lawyer. This one doesn't seem too bright.
You should have her forced to move and allow you to live in your house because she will not keep up with payments that the courts ordered her to pay. To neglect payment is to neglect a legal decision by the courts. She is therefore in violation of a court order.

Sounds like she is in contempt of court - however pursuing that remedy is expensive and time consuming and probably will not get you what you want. I would suggest that your lawyer approach the court and suggest that any payments on your mortgage that you make prior to the divorce being final be offset against any property award made in the divorce. For example - if you pay $1000 per month over the next 6 months that a total of $6000 should be deducted from any property that is awarded to her. Seems like this is a win-win situation.
Good luck.

I think you need a better attny! Foreclosure takes longer than folks expect. But in the meantime, the past due racks up.
Something doesnt sound quite right here.

sure, no one can stop you from making payments. i would do whatever i could to stop forclosure on the house. who knows, with your wife's history, she might have to end up paying for the house and you get to still live in it. of course, if she is a *****, then she might rather go to jail just so you will have to be financially struggling and pay for it. good luck with this one....divorces are nasty!
also, i would consult your lawyer and see what he/she says!

I would go back to the same court and explain the situation and ask if you can sell the house under the circumstances

are you going to lose the house to her anyway?
if you got put out of the house and the court ordered her to pay the mortgage then let her deal with it, if it forcloses then its her fault and you can sue her for the lost profits and such

You did not say if you had kids living in that house...if you do and love your kids you should pay for their sake.
If no kids sale the house and split the money.
you could always sale it for 100.00 and give her 50 just for spite.
Sale it to your lawyer.

If your name is on the house you are partly responsible for payments...doesn't matter what the divorce court says...you are legally liable for payment of mortgage if your name is on it.

Good luck with everything, I dont think you can do anything unless you pay everything in total.
