If it is in the trash, you will probably not have any trouble. Many jurisdictions hold that anyone can poke around in the garbage if they want to (including police who have no warrants).

If it is "scrap" per se, that implies that it may be recyclable and possibly worth some money, in which case it would be illegal for you to take it.

Generally.... yes. Taking something that is not yours, without authorization, can be considered larceny (theft) in most jurisdictions -- even if it is trash.

The simple way around this is to get permission from the company to take the scrap material.

It's a simple request, and the alternative is generally not worth the risk.

It is considered theft, and the company probably has a loss prevention plan implemented. The company might get credit on the "stolen" item(s). Taking anything from a company without express written permission can get you not only fired and fined, but also you can get a jail sentence.

If the garbage/scrap is still on their private property, then yes, it is stealing and therefore you can be arrested.

However, if they have placed their trash/scrap on public property (i.e. the curb) then it is no longer stealing and you can not be arrested.
