Grounds for divorce in California are:
Dissolution of the marriage or legal separation of the parties may be based on either of the following grounds, which shall be pleaded generally: (a) Irreconcilable differences.
Irreconcilable differences are those grounds which are determined by the court to be substantial reasons for not continuing the marriage and which make it appear that the marriage should be dissolved.
(b) Incurable insanity.
A marriage may be dissolved on the grounds of incurable insanity only upon proof, including competent medical or psychiatric testimony, that the insane spouse was at the time the petition was filed, and remains, incurably insane.

That depends on where your mother lives, Here in Michigan there is no fault, divorce and split everything down the middle, you leave with what you came into the marriage with. Was it her house to begin with ,if so its hers,unless he can prove he put money into it for up keep, she is better off talking to a lawyer before anything is decided. If he doesn't know she knows about the affair I'd take money out of the bank and anything else she wants out of the house too, he didn't play fair, she has to look out for herself, I'm talking from experience.

I know there are Alienation of Affection laws still in some states where the spouse can sue the homewrecker for having an affair with their husband/wife.

No, but if the person who is involved with the cheating spouse can, especially if its a Hooker, or even a NASTY ESCORT! You

If not, it should be the law.
Cheating and adultery sucks. If you take a vow, keep it, if not, leave, don't take the kids or the stuff, just go.
