I was not provided the company cell phone IAW policy. I received a call on my cell phone but was unable to call the boss as directed because I couldn't initiate calls. I was told I could have driven 3o minutes to use the company phone. My appeal was denied. I told the secretary to have the boss call to explain the need. She stated she would however she denied she heard that request.

How should I approach the next appeal?

You should really talk to a lawyer at this point if you already lost the first appeal.

Note I did not say "hire an attorney."

Find one that offers a free consultation.

And the money could be worth it, I lost about $8000 a few years ago in UI benefits because I didn't correctly appeal.

I second that, not worth hiring an atty. I have worked for the state processing UI claims, and I never heard of a decision being overturned once it reaches the higher appeal levels.

Not worth the money for a lawyer, and definetly not worth the headache.

You might want to concentrate on getting another job and chalking that one up to a bad experience. Once an appeal has been denied the decision, whether right or wrong stands.

What you might be eligible to obtain would not be worth hiring an attoney.
