I got a knock at my door at 2am last night to my neighbor, "Nick", asking if his wife, "Katie" was over here because he had woken up to an empty bed. When he found out she wasn't here he realized that she was up to no good, (again). I offered to take his two-year-old son so that he could go look for her so he brought him over. 2.5 hours later I got a knock on the door from Katie wondering if Nick had come over here because she was locked out. I replied, "yes", so she knew that she was caught. She said thanks and made her way back home. I heard some yelling through the walls, a door slam, and an elevator going down. The next morning Nick came in before going to work and asked if I could watch his son until he got back, which of course I replied "yes". He said that Katie was kicked out last night and hopefully she won't come back for her kid. He's worried that she'd do something irrational if she came and got him. Am I legally obligated to give him to her if she comes?

Yes, you have to give her (HER) child.

Their drama doesn't limit her rights as a mother, nor does it give hubby any priviledges over custody. Irrational behavior that hasn't occured yet is not enforcable by law either.

What a terrible situation he put you in.

I'm not sure about that , but if you don't answer the door she won't know you are home. But if she did come I would tell her no that you were instructed to watch him for the father. And if the police come tell them that she snuck out in the middle of the night and the father had to go to work and asked you not to give the child to her because he doesn't trust her to not take off and leave the child home alone.

wow, thats a tough one, you really don't know what has happened and stuff, morrally you are responsible for the child and giving the child back to the proper parent, being the parent that brought the kid, but being that she is the kids mom she is the parent also and there is no legal documentation to stop her from taking her own child, in fact the father himself could not stop the mother from taking her own child if she wanted to, thats just how the system is set up unfortunately

you should consult your local law enforcement division for current rules and guidelines and tell the father that he needs some type of court order prohibiting the mother from picking up the child

Stay out of the drama Try 2 explain 2 the police why you have & won't give the child back whatever she says your in the middle,she is the mother & your the neighbor or what ever she says your are.You helped 1s that enought.Just my thought.Be safe

I believe you have to. You have no legal right to keep the child because of a family argument or because she cheated. Remember there are two sides to every story. If he was really worried about the child and something happening, he should have taken the child with him or got a restraining order if appropriate.

You better stay out of this. She is the mother. You aren't clear about whether Nick is the father. If he isn't, then he doesn't have much to say. If Nick isn't the father, he may want to call the police about child abandonment.

You don't have to open your door to this women.

Hmmm. Nick has given you advanced notice that the child could be in jepardy if surrendered to the mother. Inform Nick that your not taking in said child until the situation is stable. Otherwise, tell Mom that if she wants the kid, she's welcome to him after cps leaves. Call them the minute you suspect the mother is coming. Let authorities be your friend. Tell Nick you ain't playing this anymore, it' too tough.

Yes, you are suppose to give this lady HER child. Her husband had no right to ask you to keep from doing otherwise. You'd do better to remove yourself out of their mess, and let him or her ask a family member or close friend to help with their kid.

legally you probably are obligated since it is her son; but with that said, if she does come, don't answer the door, wait for the husband to get home from work.
