when you have the child, get an attorney to file a temporary custody order with the court, its not a nice way to do it but it works

Talk to your lawyer and ask them how you can do this if at all possible and see what advice and counsel they can give you in this matter. I am not sure if you will be able to get custody right away or not if your spouse wants to fight you on it though. But if he does not fight you and just agrees to it you should not have a problem . Maybe you can get temporary custody for now if need be.

Unless you have been given a custody decision by the court, the only obstacle to custody of your child is your spouse.

simply tell your attorney you are keeping the child the next visit you get. As long as custody has not been established you are within your rights

ask for temporary custody until a final decision is made
