I live in WA state.
My ex husband owes my kids an outrageous amount of back-child support. In order to get some money from him, I had the state go after him and not they take money directly from his paycheck, but not before he owed the kids nearly $20,000.
For a couple of years, his tax return went directly to me, bringing down the total owed to the kids a little bit. However, for the past two years, I stopped getting his tax returns.
This tells me that he has stopped filing his income tax. Yes, he is selfish enough to stop filing just so I can't have the money.
How do I get the law to look into this? I have talked to the Child support system and they say can't get involved in that.
I am angry because the kids deserve the financial help and I don't know who to talk to to get that selfish man to be responsible.
Yes, he does work so he should have had to file his taxes.

Aren't we jumpy to assume? I had not idea what he was like when I married him. Had I known that he would beat me nearly to death and molest the kids, I would never have "procreated" with him.
Also, I spent four years trying to get child support from him on my own and got nothing. Had I not gotten the state involved, I could have been arrested by the state for child neglect for not getting the money that it rightfully owed to them.
Your arrogant answer shows your ignorance on the subject.

Contact the Department of Family Services in your area. They can give some guidance.
If he is not filing, the IRS will come after him for all he owes plus penalty and interest.
There are so many deadbeat dads out there. Here in NJ we have some of the toughest child support laws...if you lived here, the police would go to his workplace, arrest him and throw his butt in jail. In NJ, deadbeats can have their personal property and car seized, drivers license suspended, all bank accounts seized...Too bad WA doesn't have better laws...But then, maybe they do...check with Family Services.

If you get the right lawyer, they can put a lien on every single thing he owns, and make his life miserable. I had a sister-in-law that married a man like that. He not only owed his kids from a previous marriage a lot of money, but he started having kids with my SIL. His ex-wife put a lien on everything they had. They got their house paid off, and put it on the market to sell. Well, they sell it, and a week before they close, guess what? It has a lien. He owed his children 30 thousand dollars. The house sold for 20k. He had to give her all the profit off of that house. There are ways to get your money. Good luck with this. I really am sorry for all you've been through. God bless you...

ignore the ignorant statements made by some here.... they dont know, some are just young and stupid, just like we were.
dont take it to heart.
well, the honor system doesnt work, thats been proven.
if your not getting any tax refund intercepts from him, it could mean several things:
1) he finally dropped dead; if so, your child(ren) are entitled to collect SS.
2) hes disabled; and you would be able to get some of it i would think.
3) he filed, but owed to the IRS... screws himself with this one, but he'll find that out later on.
4) he's not filing at all.
personally, i think you need some heat on the case. you need to write a letter.
in that letter, give your contact info, case number, arrears amount, his info and the problem of no progress being made on the arrears. ask them if his drivers license is taken away. ask why they have not put leins on his bank accounts and properties. ask why hes not in jail (at least you'd get a small chunk of cash each time they did it). ask them what they are doing about this.
then take that ONE letter and FAX it to the following:
1) both states Attorney General (if you both reside in different states)
2) both states Governors
3) both states Regional FEDERAL Child Support Office
links are below for these. you see, phone calls are useless; they are denied, ignored or forgotten. mail ends up in someones "to do" pile, but FAXING is effective. its proof you sent it and proof its been recieved. therefor, they HAVE to address it. if they contact you and say 'they dont handle this or that" ask them who does. ask them why state and federal laws are not being applied to this case... all of them. ask them why he's not in jail monthly if he's not paying.
if you dont hear anything in a week, fax it again. fax it WEEKLY if need be until something is done about this. who cares if you miff someone off? the squeaky wheel gets the oil, and you squeak til they address this problem.

Of course he should have to file his taxes and support his children. However for you place the blame in the lap of the state is absurd. You chose to procreate with this person, knowing full well who he was. The state did not make that decision. This situation is equally your and your ex-spouse's fault, and therefore equally your responsibility. Child support prosecution and collection requires an enormous expenditure of wealth and time, on the taxpayers' dime. Furthermore it is difficult work performed by underpaid employees. Solve your own problems.
