Did they give you the 'Gold Brick' Award? That just stinks. I would have to say there is something fishy in the state of Denmark. Did you tell him, 'Whoever smelt it, dealt it?' That skunk, how obnoxious can you get? He must have been dyslexic, I think it said on the report that you are a 'lazy SBO!' I think that hardly works as a sufficient reason.

You could, depending on how your employer treated you and how you responded. You'll have to decide if it is worth it though.

Did your boss or supervisor tell you about your "incompetence" or "odor" and what you needed to do about it in order to keep your job. If they didn't, and just fired you on the spot and let you know after the fact, or just embarassed you in front of other workers and then fired you, that shows some unfairness on the part of your employer. A lawyer might be interested in hearing your side of the story.

If they did tell you, and told you what your options were, and you did nothing about it, then it looks like you really didn't want that job.

Are they being truthful, or are they just lying. What's the story to be told here? Honestly, were you incompetent at the job they gave you to do and did not try to improve, and did you not take care of your personal hygiene? Or did you address these issues and still got fired? Or are your boss and/or supervisor the ones who are incompetent here?

If you were treated unfairly and fired, either because your employer is just lying and you were never incompetent to begin with and never "had an odor"

or

your boss and any cohorts just decided and said, "We think you stink and you're worthless!", and your employer or company ended up firing you, you certainly do have legal recourse.

Unfortunately, it may take more than just your story to lead to actual legal action, especially if it is a large company or corporation. If a lot of people are fired unfairly like you by the same company, the necessary testimony and evidence needs to be secured and then a class action suit against the company can be justified.

Unfortunately, there are a lot of people including yourself who feel wronged because they were indeed treated unfairly. And unfortunately, most end up quitting and finding employment elsewhere than addressing and standing up to the unfair treatment. Also unfortunate is the end result where nobody wins because you've lost your job and the company ends up with a bad reputation and a high turnover rate because a few "bad eggs" somehow managed to make it to management positions and started firing everyone, Proof that a little authority is a dangerous thing.

Well, that's all I'm typing for now. Good luck with finding employment somewhere where everyone's fair and kind and honest, and I hope you were really asking this question in all honesty and this wasn't some kind of sick joke. And thanks for a very relevant and important question.

Did they warn you about incompetent? If you are not in a employment at will state then you might have a case - also depends what is in the employee manual about corrective action planning.

If the oder was the only reason they fired you then yes you have a case...see a lawyer

If the "odor" was that of weed and the incompetence was because you were high on this so called weed then no, you are out of luck. But if your "odor" is that of zebras (because everyone knows that you own some zebras), then you can probably sue him because he obviously hates everything that is black and white and that is wrong. To me zebras smell and are delicious.

If he can back up the "incompetent", I would say no. If the "odor" is the result of diet or a medical condition, I would say yes.

The judge could ask for odor in the court. Especially if the court is out of odor.

sure. you could always say your employer was sexually harassing you, and when you did not do as they wished he/she fired you because you were "incompetent" and "had an odor". but really they were just being a big baby because you didnt want to sleep with them.

I asked my cousin, bear, who studied People Being Fired for Unbelievable Reasons Law and he said he can help u, but first you have to buy him a bottle of fine Scotch whiskey with banana flavor ‘cause he doesn’t like working under pressure.
