It would be copyright infringement if she published a picture without your consent. The only way she could dispute your claim is if you have posted the same photo elsewhere on the net, and she obtained it there---public domain.

You aren't going to get her on copyright infringement, really, unless she made money on it AND prevented you from making money on the. If she did, then she would go to jail for 5 years. But, if all you want is for her to take the photo off her website, you can, even if she owns the copyright, because it is, after all, a photo of you!
