Though I will not divulge names since the case is still being investigated I'm sure you can figure it out. Is this right though? I work for company A and used a mobile from company B since company A does not have service where I live. They said that as long as I didn't bring the phone on premises then that would be fine... I brought it on campus many times because I believe I have the right to. If you sell cars or clothes for company A but where or use company B products how many times have you been terminated for this? No, it had nothing to do with anything else but the phone. I was asked and reprimanded about 10x for this. If it was anything else after 2x I would have gotten the boot. I was a top saleswomen for the last 8 years. They have even said if I drop charges and don't bring in the phone they will give me my job back. Should I fight this. I am not asking for any money except those to cover court and legal costs.

I think that you should definetly fight this, they have no right to tell you what products you can or can not use.

You knew the policy, and the policy isn't illegal. If you make good money, you should take your job back.

Panchito, in most states, employment is at-will, and they do have that right. I work at a Honda dealership. If I drove up in a new Camry, I would likely be fired. I have the right to drive what I want, they have the right to fire me. Simple as that.

You were told not to bring you phone to work numberous times and you continued to do so. They had a right to fire you.

When you work for someone, you must obey THEIR rules and leave your pettiness at home.

if i were on your jury i wouldn't give you a penny. i would side with the company. you were told not to bring the phone and you went ahead and did it anyway.
the old saying goes, act in haste repent at leisure. you acted in haste, you did what you wanted to do. now you are paying the penalty. too bad so sad.
