By "innocent," I assume you mean that the dog isn't jealous of or threatening the baby, right? Because if he is, you should dump him and not look back. Pets are lovely, but your kids have to come first.
Jailed? No. As a pet owner, you are (somewhat) legally responsible for the care of your dog. If you let him starve, you'll likely be charged with animal abuse. If you let him run free and he attacks someone, you may be subject to a lawsuit. But there is no legal restriction against taking him to an animal control center and leaving him there.
*Should* you ditch the dog? I think this depends on what you mean by "ditch" and on your own resources. I don't think there's any problem with finding a nice home for the dog. The dog will be happy, you'll be happy. Everyone wins. It's a bit more problematic if the dog is abandoned or euthanized, because then the dog is *much* worse off as a result. I think most people would agree that you should have some consideration for the feelings of your dog... especially if he's been loyal to you. How much consideration is a matter of preference. You shouldn't be working a second job to support the dog, but you may want to forgo a new TV to keep him around.
Also, why do you want to ditch the dog? If it's for money reasons, see the analysis above. If it's for time reasons... I don't think that's a good excuse. Dogs do not have to require much attention; you can always relegate them to the backyard if you don't want to deal with them constantly. They are, after all, dogs.

i don't know what you mean by ditching.
if you mean driving the dog somewhere and putting him out of the car. YES you should be jailed.
