But abortion isn't murder? I don't understand. Aren't they both fetuses?

IN GENERAL if an unborn child could conceivably survive outside the womb, with or without help from doctors, it is legally a baby aka a fetus as opposed to an embryo. Since this question is in law, here is a quote from wikipedia on the law.

"Many of the states that treat feticide as murder do not distinguish between an embryo and a fetus. However, California does make this distinction. California treats the killing of a fetus as homicide, but does not treat the killing of an embryo as homicide. Unlike California, various other states do not consider the killing of a fetus to be homicide until the fetus has reached quickening or viability."

You may or may not agree, but these definitions will help in the dialog between those who are for and against abortion. The fact that a viable baby has legal status in most places is a win for right to life without being a blow to people who think otherwise. Gradual change is the best, especially when those who are pro choice feel that way because they fear losing women's rights, especially reproductive rights.

who says abortion is not murder? Some people firmly believe it is and i'm one of them. Nobody asks anyone to go get pregnant, and then if u r, even by mistake, i mean, why kill the child even before it is born. There should be laws against it, but sometimes in rape cases especially, the victims are too young, so um... i would say it is difficult for them to maintain a child along with themselves and so, abortion can be done as a last resort. NOW, returning to your question, um... murdering a pregnant woman is a double murder because not only you are murdering the mother (the first homicide) but u are killing an unsuspecting child who has not even been born, not done you any harm but is after all a living thing. And also, killing a pregnant mother means that the mother accepts her child so, it's murder. the mother is the first one who has a right over the child's life, more than anybody else. Abortion is something that should be approved by the mother, so it's not exactly a murder, or so they say. i think i have messed up my answer, but ur question kinda got me thinking too.

Abortion used to be against the law and will be again. Your question is a very good one. In all states, murdering a pregnant woman is not a double homicide, just some of the states.

Because the woman has the choice over her own body in both instances. If a woman is pregnant, and someone takes away her choice to carry the baby by murder, then they are stealing away her liberties.

Yes, and abortion is murder, it is just legal in some states until threw the first trimester.
The first few weeks the baby is called an embryo, then fetuses.
But life is life and should be treated as such.

You are killing the fetus. The woman carrying the fetus might not want the baby to die. therefore you get a double homicide.

i guess because the girl has a 'choice' of 'killing' the fetus or not killing it. where as murder is murder
