The rent should have been pro- rated. However, if you signed a rental agreement with the landlord then you are probably stuck paying for Mar 1st. Sorry, I know it sucks.

He cannot throw you out immedetly.It would take months just to go to a judge.If he wanted you out. Why didnt you move in on the 1st of Febuary? Was it his fault? ie. Place not ready? If it was then I would make him prorate the rent for the time you were not there. If you have a contract it should state when your rent is due and how many days you have to pay it. if he gets threatening tell him you have a relative thats an attorney and that either he prorates it and gets off your back or you'll be living in his place and will keep his *** tied up in court till he's 90. Make sure you keep every converation logged and when you speak with him say something like this conversation is being recorded. Just the fear of ending up in court should get him to back off.

you need to know your state's law as each is different. for the most part, you need to be given a certain # of days notice before you can be evicted. in arizona it's a 5 day notice & after that you can be brought to court - but you can't be "kicked out" until the court orders it. during that time, if you pay rent, you can stay (it will put a black eye on your credit, but you will have your apartment). if the agreement was for a full months rent & you paid that, even if you only lived there for 1/2 the month, that is something you agreed to when you paid. he is right & full rent is due. but pay before any action is taken against you.

If you didn't move in until the middle of the month then that is when your rent should be due..or the landlord should have pro-rated the rent just for the time that you lived there....if for some reason this goes to court he doesn't have a leg to stand on

So you knew this going in. I'm going to have to say the Landlord is a total jerk but it's not like this person forced you. You knew when rent if due and now you are going to be late. Not a great way to start a business transaction. You guys should not have moved in this jerks place.

It's really up to him. If you lease says you have to pay by the first, and you havn't, there probably isn't any recourse for you, since you agreed to it. I personally would let you slide for a week or so, it wouldn't be worth evicting. Just don't make it a habit. Good luck.

You should have had him put that in writing and discussed it with him before now,Bring it to his attention nicely at first he should give you until day you moved in
