A woman got a divorce at the end of 2006. She did not have income and most likely filed taxes with her ex-huasband. They do not have kids and live in NYC. Is she supposed to file married filinf jointly, separate or single?

Filing status is determined as of 12/31 of the tax year.

If she was divorced on 12/31/06, then she MUST filed Single.

If she was still married on 12/31/06, then she can file EITHER married-joint or married-filing separate.

Her marital status at the end of the year determines her filing status. If the divorce was final by 12/31/06, she files as single. If she receives alimony, this IS considered income for tax purposes. Her final divorce decree will have the info as to whether or not she needs to file.

If she got a divorce any time in 2006, then she would have been single at the end of the year, so that would be her filing status. But if she didn't have income in 2006, then she wouldn't have to file.
