He has to decide this himself. From my experience, he should ensure that he retains custody of any children.
She is free to go, and be allowed liberal visitation, but neither he, nor the children should leave the marital home.

Have your brother suggest marriage counseling and that she stay in the home. Her moving out will only cause more problems and make it tougher to resolve the issues. If she does end up moving out, make sure your brother either keeps your niece with him or immediately alerts a lawyer -- in the future if there is a divorce, his chances of getting more than usual visitation or even custody will be greater. Maybe she just needs time to work some things out. Just because she wants a separation does not necessarily mean that she wants a divorce. Isn't it better that she wants some time to see if she thinks the marriage can be saved rather than just ending it. He should give her a little bit of time.

It depends on the reason for the separation. Why does she want it? I would never advise someone to get divorced unless it was truly a done deal.

I personally would go to my brother and talk to him.I would try to get him to realize that she is just using him.He is her backup plan.She probably has a new man on the side.And she just wants to string your brother along just in case her new man doesn't work out.I would advise him to tell her it is all or nothing.Either she is all in or all out.But anyway she looks at it her game is over.
