What do I need to do to change my custody and visitation order? I know I can go get it modified, but doesn't that cost money?? My 2 daughters father has just gone back to jail, for the umpteenth time. He is going to be there until June of this year, but I am tired of having my girls go through this just about every year. I looked up his booking info, and found out he has plead guilty to having sex with a minor and failure to register. I'm taking it that he is supposed to register as a sex offender, which of course he said he didn't. He is supposed to have my girls two weeks on and one week off all summer long, then we alternate weekends. I want to get this changed but can't afford a lawyer since he doesn't even pay his lousy $97 a month child support the court ordered! What can I do??

Its very uncommon for a father to have extra rights in custody of a new child than a mom. for sure it particularly is one among the few the place the fathers has the new child extra. even nevertheless, based on your description of the mum, who has NO criminal record, NO Drug or Alchohol dependance, and keeps a sturdy person supervision collectively as the new child is there. potential................. That her custody will in basic terms improve somewhat than shrink. on condition that there is not something incorrect with the mum in any way. in basic terms ingredient which will forestall a mom gaining extra custody while the two mom and dad are sturdy human beings. is that if shifting between residences impacts the childs education. shifting from homestead to homestead mid week, unsettles a childs education. subsequently extra advantageous than probable if new child is of school age. it particularly is going to save on with 5 days with one discern, and on the weekend 2 days with the different.

Many areas have legal assitance for those in situations like yours. If not, try to have a consultation with an attorney, ask all kinds of questions, write what he says down and then you do as much of it as possible. If he's in jail for those charges, no judge in his/her right mind will allow underage children alone with him.

Ask your friends who have children and are divorced to show you their divorce papers if they had any changes made and copy their attorney's work.

Contact your local Department of Family Services and ask to speak with a social worker. Explain the situation...they can help you.
