He is making everyone, including his own children miserable. Wines and cries about every little penny and piece of furniture. He has everything already! I just want this over with so everyone can move on. Its best for the kids that way.

Sounds like he is enjoying tying things up for you and doesn't much care or realize what he's doing to the children. Talk to your lawyer, that's what you are paying him for, and tell him to get this in front of a judge ASAP. In most cases like this, the judge will do for you what the soon-to-be-ex won't. You are right, for the kids sake, this needs to end quickly. Prepare yourself, he won't like it, and he may cause a stink for a while but in the end it will work out for you. Good luck.

I believe that after a certain time of separation you can have a divorce finalized, especially if you can show that they are intentionally holding out on you. The best thing to do is consult a divorce lawyer or even talk to the judge that authorized the proceedings. I believe in my papers there was a time limit. If I didn't sign within so many days she got whatever she was asking for without an appeal.

If he is refusing to sign the papers, you can ask the judge for a summary judgement against him.

When you are divorcing someone, you are basically suing them. Their refusal to sign the papers consitutes them basically not making their court date.

The judge will give him either 30 days to sign a final settlement, after that passes, the divorce can be finalized without his signature.

The time frame may vary from state to state. I suggest consulting your attorney.

You can't make him sign, but if you want this divorce to be finalized take it to court the judge will look at the situation and grant the divorce without him signing

You can't force him to sign, but you can ask him what sort of agreement will he sign?

They can't force him to sign either, but perhaps the judge can decide on how the marital property is distributed and after a certain period of time, certify the divorce as final without his signature.

Most states allow even contested divorces to be finalized without the agreement of one of the spouses.

Ask your lawyer.

Do a Motion to Set for Trial. Get in front of the judge who will then sign off on the Decree.

If you guys have lived in seperate residences for that long....and I mean without any of him staying for two to 3 weeks at a time with months between....but I mean total seperation....you can usually go to a lawyer and have the paperwork pulled through that way.....he cannot force you to stay in a marriage just by not signing the paper.....go see your lawyer.

he could drag you back and forth to court forever! not sure why the judge hasnt granted the divorce itself...but as far as custody and support, etc., can be dragged around forever...believe me..im going thru it twice a year...its ridiculous! the judge can make a decision for him/you and then your ex can ignore it for a long time...your attorney can get the judge to sign months later for him...then your ex begins again. thats what mine has done so far! ughh!! stay on top of your attorney...the squeaky wheel gets oiled! good luck peace
