i dont live with him and i got a letter stating he filed he gets social security now does that mean my kids will get a check for child support cause he dont pay child support he owes me 28,000 dollars????

It depends. There are two kinds of disability income that people might mean when they say "Social Security Disability".

If he was approved for Social Security Disability Insurance (SSDI), then the kids should qualify for monthly benefits until they turn 18, or 19 if they are still in HS. There will be back pay if there was a time period between when he applied for benefits and when he was approved for benefits. The problem is that he probably put himself down as the representative payee for the children's benefits. Contact your local Social Security office and ask them if your children are getting benefits. You'll need their social security numbers to find out.

Was the letter you received from the Social Security Administration? Hopefully it was, and they know that the children live with you so that you will get the benefits. Like I said, call the local Social Security office and ask them.

The other type of benefit is Supplemental Security Income (SSI). This is a type of welfare for people who are disabled but who haven't worked long enough under the Social Security System. If this is what he is getting, the kids are not eligible for benefits.
