Personally, I think the one who doesn't want to remain married should leave.
To force the other person to leave is just a power and control tactic.
If she doesn't want to remain married to him, then she should leave.
I would say the same to a man who wanted to end the marriage.
It's called the marital home. If you no longer want to be married, then it makes no sense to want to remain in the marital home.

Usually not just if divorce papers are served. Unless there has been allegations of domestic abuse and the Judge has signed an order removing you from the home (which isn't a normal part of a regular divorce itself), no.

no one has to leave unless their is a court order stating so. The home is community property of the marriag and its the judge who decides who gets what so no one has more power or reason to be in the house than the other until your proceedings get started.

One should leave but I guess if you can peacefully live together more power to you. There are people out there that do it. But it has to be a mutal thing.

It all depend on what the petition marks down... If she wants the husband to leave, then she can request that. And the husband has to file a response to ask to get that changed....

because in most divorces the women gets custody of the kids so the women gets the house because the kids need a place to live it suxs but that's the way it is
