I am 23 and my mother claimed me on her taxes because I was still in Law school until May 2006. Do I need to file taxes? I did earn wages as a waitress. Any tips for filing taxes as a waitress?

If you made over $5150, including your tips which I assume were all reported, then you'd have to file. If you made less and didn't have unreported tips, then no you don't, but if anything was withheld for federal income tax, then you should file to get it refunded to you.

yes if you want your withholdings back and also you are suppose to file if you had any income. As a waitress the 1st question is did you claim you tips. If not you need to claim them on you tax form because that is a likely hood that you can get audited from that. Keep in mind that the average person tips about 10-15% so claim about 8% to be on the safe side tech. you should claim all but why?

You need to file. You should claim your tips as a waitress and it's OK to estimate them. If you put zero you are asking for trouble so put something. Also consider whether you may need your tax return to apply for credit or a job. If you show less income it could hurt you in these endeavors. Some people over report income and pay a little extra in taxes to show higher income for other purposes. It's best to try to report correctly because you may start down the wrong road in a small way now only to continue down the road in a bigger way in the future. Do the right thing.

If you earned more than $5,150 in wages, you MUST file. If you earned less but had income tax withheld, you need to file to get those taxes refunded to you.

Filing tips for wait staff: Properly claim your tip income with your employer in any month that you earn $20 or more in tips. Don't forget, if you have any tip outs, you MUST report those to your employer; you CANNOT adjust for them when you file your tax return.

There's always a chance that you could get a refund, or owe money. You never know unless you file. If what you made as a waitress was low, then it's more likely you will get a refund.

yes just claim zero exemptions when you file, if you got a W2 then you need to file, its your money that you'll be getting back.
