Wondering if I should seek advice from an attorney since my spouse is thinking of leaving us (me and our children)
I dont want to get stuck since on my pay alone I can't make all the house payments and utilities along with the support of the children
I want to work everything out with spouse but sometimes it is like there is no trying on that side of the coin.

If she is leaving (hey, women leave too) she still must contribute child support.

I hear you. My wife left years ago, I still wanted to try. But as you said so well, sometimes the other side of the coin doesn't want to try.

Legal advice is probably what you will need, sounds like your spouse is already gone if she does not want to try to work things out. Most woman (the one's I know) sometimes go through their own "thing" and unless you have done something like cheat or hit her then I don't think she is leaving you "just because" she probably needs some time alone to think out what she wants. I am sorry you are going through this. As far as the legal advice I would consult an attorney just to ween out options in case she is gone for good, and once she is that would be the time I would take a legal action. If she is going through something and you add legal action before she has made a decision at her own personal cross road you might end up destroying any possibility of rectifying things. Keep your chin up; everything will work out the way it is supposed to.

Id consult an lawyer the first visits free. Find out what you should do in your state. Go back to the husband tell him you will be needing x amount of dollars which week to support the kids and pay the bills, if he puts up any kind of fight then go back to the lawyer get a court date asap. I have a friends thats husband says hes leaving when he doesnt get his way and throwing a fit. The last time he said it she told him she was keeping the truck that was paid off and he needed to take the camper, and car that werent paid off. How much money shed be needing, she also had some money saved up to help cover the bills and tresfered all the credit cards she owed on to one of his credit card bills so if and when he left he owed for them not her. When he said he was leaving after she told him how much money she wanted she asked if he needed her to clean the kids and her stuff out of the camper now while he was packing his clothes. This shut him up now when he throws fits he doesnt mention leaving.

Contact the atty right away because it's necessary in order to protect yourself and the kids. Also, be cautious in case you have a joint account and hubby decides to withdrawl all the money - just be aware of that.

If he is leaving...then seek legal advice. I know that it hurts and that you may feel like you are "betraying" your husband by doing so, but you have to protect your interests and your children.

You ABSOLUTELY NEED TO CONSULT WITH AN ATTORNEY. Most people wait until its too late. You wouldn't do your own open heart surgery, dont do your own legal work

it would not hurt to get one, you have to think of the welfare of your children, they will be depending on you. Besides the more you know the better off you are. No one ever complains about too much knowledge.
