you can kick them out ! It is violation of the lease. You can also have the "middle man'', who sublett the apartment to the "tenant" to for the cost of porcuring another tenant: paying real estate commissions, paying rent until another tenant is found or until the end of the term.

In this situation if you are renting the apartment out to someone, and subletting is not a part of the lease you have the right to terminate the lease. Not only on the grounds that he's not paying rent on time but breaking the lease the was signed and completely knowlegeable to the the renter. So you have grounds to give an eviction notice. If you don't want to go that route at least speak to the tenant and explain it wasn't part of the lease and that the rent needs to be paid on time as well as the whoever else is living there needs to go or you will issue an eviction notice.

Subletting is prohibited in the Lease, which I will assume is in writing and a one year lease.
You have the right to evict for Breach of Contract (if the lessee is of legal age...in which case the lease would be Voidable anyway) through a legal process known as "Actual Eviction". The Landlord MUST serve notice to the tennant before commencing the lawsuit
requiring a 10 day notice. When a court issues a judgement for possession to a landlord, the tennant must vacate. If the tennant fails to vacate, you may have the judgement enforced by a court officer who will forcibaly remove the tennant(s) and their possessions. You will then have the right to re-enter and regain possession.
For Rent Defaults, usually in most states, only a 5 day notice is required.

Well, if the other names are not in the lease and he is not paying rent on time that should be grounds for bridge of contract. Talk to the tenant and document everything. Then talk to an attorney and see how you could evict this person. Make sure you document everything.

If subletting isn't part of the lease, then you have every legal recourse to evict. To to the local courthouse where you live and ask how to start the evction process. They will have the paperwork there.
