My ex girlfriend that I was with for 6 months that I split up with because she was being too suffocating has booked a holiday a couple of days before we finished without telling me & paid the full deposit. She is now saying that if I dont pay her the deposit she will take me to the claims court but she never even asked me to go away. I simply cant afford the amount she is asking for & dont want it to go to court. She has no signature to say I agreed to anything, she is just causing me so many problems & I dont know what to do. Any advice?

You do not have to worry. You had no idea that the holiday was booked and did not intend to go on the holiday.

That is like going out and buying someone a new car without there knowledge and then trying to take them to court because they won't pay for it!

Her case will never stand up, you just need to convince them that you had no knowledge of the holiday being booked which I am sure will be easy if you can show that you do not have the means to pay for the holiday which you said in your question!

It will be her word against yours and that will not stand up in court unless she has any solid evidence that you knew about the holiday.

Tell her you're not interested, it's her problem, and then cut off all contact and ignore her.

If it's a package holiday & she can find someone else to go with her, presumably she can just pay an amendment fee (used to be about £10) to change the name, if she gets a move on and it's more than two months before the holiday (when the balance has to be paid & tickets might be issued). If she goes to court & your signature's not on the booking form, she'll get nowhere; the person who signs is responsible.

She sounds like a right pain in the butt. Be strong!

It was booked without your knowledge so you cannot be expected to pay anything. She could always take a friend with her, just transfer the names its easily done at this stage.

Simply tell her that you cannot afford to re-imburse her the cost of the deposit and she has no legal rights to ask you to, allow her to take it to the small claims court if she wants to because based on the information you have given, she'll end up incurring more costs from the court.

If she booked the holiday and paid for it then she is liable...are you sure this is not just a ploy to get you back.

Best advice tell her you have no intention of paying and mention that she might find she can take someone else instead like her mum.

Don't beat yourself up about it.

Are you sure you never hinted at wanting to go on hols with her? Regardless, she has absolutely no right to demand any money from you as this was not a joint decision.

Go on, let her take you to court just so that she can see that her case doesn't have a leg to stand on! Maybe she won't make anymore rash decisions in future.

tell her to take you to the claims court, she booked the holiday without asking its her own fault, tell her to see if somebody else can go in your place, name on the tickets can be changed

What a *****, she'll have have hard time proving that you both made an agreement. Why can't she just change the ticket with your name to one of her friend's name, there might be a small fee, but that seems a lot fairer. Try suggesting that to her.

If not, go and spend your time seperately flirting with as many chicks as possible. She proabbly trying to rekindle the flame...

If you DID go, then ud be liable to pay her. On the other hand, if you didnt go and u didnt know abt it, then just ignore her. Good luck!
