Remember the Government has unlimited money to defend itself. They have the resources of 200 million taxpayers. If you are going to try to sue for something as nebulous as "Emotional Distress" you best have a good lawyer and a slam dunk case.

Our U.S. Troops choose to be enlisted.. (Not as in Vietnam when they were chosen by the date you were born) ....Just as Police Officer's, and/or ANYone else doing a more risky career in America chooses, so they knew prior their occupation to serve and protect and yadi,yadi yadi....They choose to and for a varies reason's and know one day while protecting our U.S it may come to that... And Yes, some DO and should receive more than what they have been offered by the Gov, which still sucks, yet it's worth making a point to attempt, not just because they are bigger.. I would LOVE a chance to go after our Government for screwing with my Patient s and their Wart Against Drugs last several year's, as I see so many patients suffering from not being able to fill their legal prescription, so it is heartbreaking...To say the least! I hope someone stands up for ALL those suffering and also WIN! Think the media would help this case along,as well..
Btw..Before other comments come flooding in about Armed Services.... I have a lot of Family over sea's and still enlisted.

Yes. If you sue the fed'l, state or a local government your recovery of damages is not restricted EXCEPT in my state you cannot get punitive damages against a government. You can get emotional distress. However, that issue was not settled in my state until the 1960's in a case called Dominguez v. Stone.

If you've got the money you can sue them for whatever you like.

Of course, by "the Government" you mean the Taxpayer.

Emotional stress - get a grip, soldiers are dying daily in Afganistan and are losing limbs and they will hardly get a penny.
Do you deserve more than those who have put their lives on the line. What sort of emotional stress have you got?

not except the state gotten smaller with them and agreed to grant citizenship in replace for fee presented and then gained the fee presented yet did not award citizenship. in any different case, the state does not owe citizenship to all of us not born here.

You can sue anyone you wish. It is winning that is the issue.
