i was sighed off sick i recieved a medical certificate,i returned back to the doctor before it ran out as it was over the new year period and the surgery was closed he wrote me another sick note for two weeks not adding a date i thought this one became active after the first one ran out but according to my employers it did,nt and i was sacked for unaurthorized absence,Does one sick note cancel the other

I was off work for over six weeks due to a broken cheek bone, and my doctor gave me more than one sick note which continued after the first one expired. Your employers are definitely in the wrong here, and I think that you would have a good case for a tribunal. Good luck with it, and sorry to hear that you had to go through this.

Your first sick note had not expired. It was superceded by the second sick note. You should ascertain the appeals procedure in place for your employer as you appear to have been dismissed through ignorance, a misunderstood procedure and not an intention to deceive. If you have more than 1 years continuous employment with this employer you can take your case to an employment tribunal. Contact a local employment solicitor or your CAB for advice.

Yes one does cancel the other one out - it starts from the date it was issued. However, due to the time of year, i would have thought your employer would have been more understanding.
It would still be worth phoning the CAB.

Sorry to hear your plight, all sick notes should be dated to run concurrent, i think your employer has got it in for you, do you have a good attendance record previous to this?, it sounds like unfair dismisal to me, contact your Trade Union if you are a member, and save all documentation from your employer giving the reason for your dismisal, it will be needed in case you take them to a tribuneral.

He could back date it for you if you were truly sick and can back this up somehow. Its worth a try.
There might be a case for constructive dismissal..

they cannot sack you on the first instance of UA, your GP could have easily explained it if your employers had phoned them.
