Yes, but if you reside in another state from your child they can only garnish your federal. Always claim 1 on your W-4, it makes life hella easier at tax time in this situation.

yes the federal taxes can be held due to back childsupport and in my state if for some reason he receives any kind of settlement from the court from a lawsuit or if he at anytime files for social security disability a portion of that money is held too not that its a timely action but in the end you can get the money owed but on that same issue if the mother has received any type of help from the state (in my stste anyway) if the state goes after the father for back payments the mother only receives 50.00 form the amout the collect no matter how much they get from the father

Not unless you or the state you live in has informed the IRS. They have no way of knowing you owes back child support. Does ex pay you direct or is it taken from his wages??? If it is collect by the state, then mailed to you as a check, from his wages then the IRS may know, but you still have to submit a form letter no later then Sept or Nov of the year he was behind.

it is a Federal Law to intercept the taxes, so it just depends if your caseworker has submitted it for tax refund intercept yet or not.

call your caseworker and find out if its been submitted.
