In Ca. what happens when you get busted driving on a suspended lisence, go to court for that and get put on 2 years court probation, still don't have a lisence, then 2 weeks later get caught again driving on a suspended lisence? Any advice? Get a lawyer? Will my lisence get held for a year now over what started out to be minor traffic tickets? This sux because I love to drive and I can't go a whole year, definetly will go insane! thanks all for your help! Oh and about $3000.00 in impound and ticket/court fees so far... Driving is definitely a priveledge because they own it.

First off, you are not only guilty of a new offense, discussed below, but you are also in violation of probation for the first offense, and can expect to be punished for that as well.

You are guilty of driving with a suspended license with a prior conviction of that same offense within five years. The sentencing depends upon why it was suspended. If it was for DUI, then you are looking at a minimum of 30 days in jail, up to one year, and a fine which would probably be around $1,500, but could be as high as $6,500. (Veh. Code sec. 14601.2.)

If it was for other serous reasons like reckless driving, negligent driving, etc., then you are looking at a minimum of 10 days in jail if you are not given probation, and probably some jail time even if you are put back on probation (especially with a probation violation), and probably a substantial fine. (Veh. Code sec. 14601.)

If it was for other reasons (like failure to have insurance), then you are looking at a minimum of five days in jail if you are not given probation, and maybe some jail time even if you are placed on probation, and a substantial fine. (Veh. Code sec. 14601.1.)

They can also forfeit your car. (Veh. Code sec. 14607.6.)

I don't have the precise statute, but you can expect the period of suspension to be prolonged.

You most definitely need a lawyer.

First you should find out why your lisence was suspened, then your should get all your fines paid off, then you need to find someone to drive you around until you can go back and get your lisence and start driving agian. After you get your lisence back you need to be smart and take care of your lisence so it wont get suspended again.

Driving is a privilege--not because anyone OWNS it. It's because there is a lot of responsibility that goes along with the privilege and you don't sound like you are responsible enough to drive. Don't they have the 'three strikes' law in Calif.? You'll be lucky if you only lose your license for 1 year. Personally, I hope they keep it until you grow up.
