It actually depends on where they were born in order to change their birth certificate, which is needed for marriage. Most states and countries allow the person to change their sex marker to the other when they complete sex reassignment surgery, but not all. http://www.drbecky.com/birthcert.html lists what states will change the marker, and how to get them to do so.
If they get the marker on their birth certificate changed then yes, they are female under all aspects of the law and can get married to a man. A woman marrying a man isn't gay marriage, although I have nothing against gay marriage, transsexual women are women who just happened to have a penis at birth, they definitely didn't choose it and go through alot of pain to lose it.

The only I know a little bit about this answer is, a transsexual was arrested in the county where I worked and was put in jail. From the waist up she was a girl from the waist down she was a guy. They called me in off patrol to do the strip search ( they thought as a joke) after we talked she told them I would do the strip search because none of THEM could handle it. While I was getting her changed they were trying to decide what cell block to put her in. The A$$ wipes decided to throw her in with the men. Well after the fight they put her in a single cell because part of what they said made since. She still had a penis that would make A LOT of rough women happy. She had beautiful breasts that could have gotten her hurt if not killed. So I got my way and placed her in a protection cell and made it my business that she didn't have to eat what the red necks cooked (and God knows what else). So I know in jail she was LEGALLY a man.

It depends on where you're at. Some places require the operation or at least an orchiectomy before they'll allow the legal documentation to be changed. I know New York is one place that doesn't require surgery before they'll change the documentation. Sometimes places can be tricked into changing the driver's license though. I'm not sure what ID's are needed for a marriage certificate though...

What an interesting question. Sounds like one for jery springer . If your worried about marriage, why would it matter ? Gay people get married every day .
Another thought comes to mind, whenever filling out any applications, when it ask M or F , have him cross both out and fill it in Y for Yes .

definitely an interesting question. each country and each state may have differing rules and laws..
most of the world seems to support the concept of marriage being two "people" as opposed to "opposite sex only"
but the bigger issues could come into play in things like sport.. i am a pre-op transsexual who does plan to go all the way with transition.. it will be interesting to see what happens when i register to run a marathon and they ask me my sex!

No, not until they have completed their Gender Reassignment surgury. ONLY then can they petition the courts to legally change their birth certificate...but only if their state of residence allows it, not all do.
You really should check with your state's legal information website, if your state has one...or contact your attorney general.

it is possible once all the documentation is taken care of meaning birth ceritificate licsence ss card and completed surgery of course then yes by court order your marriage can be legal

I saw a program on Discovery .They get new Birth certificates ....If they get an operation they can have female to male sex .....
