I have been divorced from my husband for three years. We have joint custody, me being primary custodian. I've had trouble receiving money from him the last year and also he has gone back to doing cocaine and drinking heavily almost every day. I have witnessed this myself and I want to file for child support so that I can make sure he pays it every month and I want him supervised when she visits. How do I go about this without hiring a lawyer? I do not have the money (single, two jobs and debt)

You cannot NOT have the money when it comes to your child. There are legal aid services if you do not have family that can help you. Whatever you do, you need to do it FAST because your child's safety is of utmost importance. But remember you need to be sure of this not just starting something because of the money. The court will not look to kindly on that if you have no evidence. I would start with protective services because they can drug test him on the spot and provide the supervised visitation for your daughter. You probably should have gone through the courts for child support to begin with because when you don't from the beginning the other parent takes advantage of that and gives sob stories all the time on how they can't afford it this week or whatever ( happened to me).

I would highly recommend pinching pennies to get the money to pay for the lawyer. Save up for a couple months believe me it is worth it. I had an awsome lawyer and because of my ex's actions I have full custody and he does have open visitation but hasn't made any attempt to see his son in 2 years. But the visitation is to be with me and he can't leave the county and my son has to be back in my care before dark each night. It is also stated the I can terminate the visit if I suspect he is on any mind altering substance at any point of the visit. As for child support I have it court ordered and it is garnished by the state from his checks and it also will attach to workers comp. I strongly recommend getting the lawyer. It's much easier when he calls sreaming because he doesn't like it you can just say call my lawyer. Best of luck.

Contact the department of social services, they can put you in touch with the people that handle child support. I assume there was a child support order in the divorce, you just need to show them the papers and they will help you get your support. Then contact your local hospital, they can put you in touch with a family visitation center where you can set up supervised visits. These sometimes cost but they adjust the cost depending on your income. Once you have everything in place, tell your ex that the only way he can see his daughter is supervised. Most likely he will not want to be supervised and will stop wanting to see your child.

EVERY state offers little to no cost child support attorneys adn services. Contact your local social services (fodd stamp) office and they will have the contact information.

Also, most states have legal aid. That is free or low fee lawyer for civil cases. Again, social services will probably have that number. They can handle custody/visitation issues.

If you can PROVE the cocane... you can get mandated court orders... and a probation officer... he will have to deal with drug court and urine samples....

You can also see if child proection services (or whatever they are called in your state) will try to asses the danger factor with him. They MAY be willing to help...

okay i have kind of been in a simaliar situation. If you are short on dough, there is an office in the juvenile and domestics courthouse called an intake office. if you go there and tell them you need to file for an emergency protective order they will walk you through the forms. you will have a court hearing within 24-48 hours and you can explain to the judge the situation and show them any proff you may have. on the child support issue, try the division of child support enforcement. they will garnish his paycheck and do all of the work for you. good luck

Contact your local Department of Human Resources (not sure what it is called in your state). These are the people the handle child support issues, abuse allegations, etc. and work closely with the police and district attorney's office.

you can go to the court house and file for a waver so you dont have pay and asked for full custody because of heath and safty reason intell he get treatment and test for cocaine and child support is a good ideal so they will get you money before the dealer do good luck also you dont want your child around that mess my brother did drug and three people went to his house and kill him that why you have to protect her

I hope you have better luck than I did. This is the way my daughters father was and still is, he got his visits, drinks and drives with her in the car and she has told everyone this. Nothing happens to him. He has not helped me in any way , and i have cpurt ordered child support that he never pays, and ...nothng happens to him. He has set visitations ,court ordered and never shows up. nothing happens to him. i truely wish you better luck than I have had. I too havn't the money but I scrape by and manage to give her what she needs.

Get advice from family court. There is legal aid and child protective services as well. Get moving girl.
