My friend and i and her daughter, moved into a place together last year and i moved out recently due to (to much drama and just not getting along with the daughter and roomate) I paid half the damage deposit and 400$ of the rent each month. My roomate was always late with her rent, i was on time! i moved out and now i was wondering if im eligible for my damage deposit back. I called to talk to the landlord and she says that i should talk to my roomate which we arent talkin anymore(how it always ends)
the landlord says that she rented it to my roomate and i was just a subtenant so she will be giving the whole damage depost to my roomate. So i dont agree but then they say i signed something saying i wouldnt move out before a year.. but if i wasnt the 1st tenant doesnt that now apply my roomate still lives there. and she doesnt think i get my DD back either. ??? do i or dont i ?

While there may be a lot of other details, you either have a lease or you do not. And it sounds like you do not. So when you paid your 400 deposit, it was a verbal agreement between you and your roommate, and as the saying goes, that is as good as the paper it is written on. And even if you had a written sub-lease agreement, I doubt you would ever collect your $400.
IF the landlord returns the deposit, he will send it to the person on the lease. Also if your ex-roomate was past due, he will probably hold back the deposit for late fees or rent.
Summary - forget the 400. Take care.

if you didn't sign the lease in your name then you and your other roomies had made an agreement among yourselves and can only recover from him. You leaving becasue of too much drama doesn't mean anything to landlord/tenant laws.
